Fox Smith Partners, Margaret Gentzen and Jessica Reis, successfully won an appeal on behalf of Valhalla Restaurants, LLC d/b/a McDonalds® before the Missouri Court of Appeals for the Southern District, in Valhalla Restaurants, LLC v. Page. The appeal challenged the Labor and Industrial Relations Commission’s decision affirming that the Claimant was eligible for unemployment benefits following her termination.
The Court of Appeals reversed the Commission’s decision, finding “substantial, competent (and undisputed) evidence on the record as a whole supports a finding that Claimant engaged in misconduct connected with her work.” The Commission’s award of unemployment benefits was deemed contrary to the overwhelming weight of the evidence, and therefore reversed. As a result, the Respondent, Page, was deemed ineligible for unemployment benefits.
