Seventh Circuit sides with Fox Smith argument in RICO suit

The Seventh Circuit Court of Appeals recently affirmed a district court’s order of dismissal in favor of a lawyer whom Richard Korn represented in a civil RICO lawsuit alleging damages in excess of $5,000,000. The district court, relying on Supreme Court and Seventh Circuit precedent, ruled the plaintiffs’ claims were barred by the four-year statute of limitations applicable to RICO actions. The three-judge panel of the Court of Appeals agreed and also found that even if the action had been timely filed, plaintiffs had failed to state viable RICO claims against Richard’s client.
