Richard Korn and Sarah Mangelsdorf Win Arbitration Hearing in Kansas City, Missouri

Richard Korn and Sarah Mangelsdorf obtained a favorable decision for their client, a national telecommunications provider, in an arbitration hearing in Kansas City, Missouri. In the case, the claimant alleged he suffered from numerous physical and emotional injuries as a result of erroneous bills he received from respondent after discontinuing his connection services. Claimant submitted claims of negligence and negligent infliction of emotional distress, including a request for punitive damages. In total, claimant sought $74,000.00 in actual and punitive damages against respondent.

Richard and Sarah developed a theme in the case which demonstrated that claimant suffered from pre-existing medical conditions, but that he failed to meet his burden of proof showing he suffered any damages as a result of respondent’s negligence. Richard and Sarah also successfully argued that claimant failed to produce any medical records or expert testimony in support of his claims for damages, as required under Missouri law. The arbitrator ultimately found that claimant failed to produce any evidence of diagnosable medical injury of sufficient severity to be medically significant and found all issued in favor of respondent.
